These Terms of Service ("Agreement" or "Terms") are entered into by and between Inverse Gratitude LLC, an Illinois limited liability company ("Inverse Gratitude," "we," "us," or "our"), and you ("you," "your," or "User").
Important notice regarding arbitration
Section 18 of this agreement contains a binding arbitration agreement and a class action waiver. Unless you opt out:
Inverse Gratitude LLC is an Illinois limited liability company that provides educational and perspective-shifting content, including reflective prompts and exercises designed to encourage personal insight and gratitude practices (the "Service"). The Service is delivered via our mobile application (iOS), our website, and our SMS/text messaging program.
(a) Standalone Consent. Enrollment in our SMS program is a separate, voluntary action. You consent to receive recurring automated text messages only by affirmatively opting in via our app or web form. Consent is not a condition of purchase or a requirement to use other parts of our Service.
(b) Messages. Messages may include reflective prompts, visualization exercises, reminders, or service-related notices. They are typically sent between 8:00 a.m. and 8:00 p.m. local time.
(c) Rates. Message frequency varies. Message and data rates may apply depending on your mobile carrier.
(d) Opt-Out and Support. You may opt out at any time by replying STOP. For help, reply HELP or email hello@inversegratitude.com.
The reflective stories and prompts in the Service are created with the assistance of artificial intelligence. All AI-generated content is pre-generated, reviewed, and curated before being made available. By using the Service, you acknowledge that the content you receive is AI-assisted.
The Service does not provide medical, mental health, or legal advice. Any information found through the Service is for educational and reflective purposes only and is not a replacement for professional evaluation, diagnosis, or treatment. You should consult a qualified healthcare provider, mental health professional, or attorney for any specific concerns. Inverse Gratitude is not a medical or mental health provider.
By accessing the Service, you represent that: (a) You have read and agree to these Terms; (b) You are 18 or older; (c) You have the authority to enter into this Agreement; and (d) You will comply with all applicable laws.
(a) Anonymous Accounts. Our mobile app may create an anonymous account on first launch to allow immediate use of the Service. You may later link an email address to your account to enable cross-device access and account recovery.
(b) Account Security. You are responsible for maintaining the security of your account and any devices used to access the Service.
(c) Account Deletion. You may delete your account at any time from within the app settings. Deletion permanently removes all personal data associated with your account. Active subscriptions must be cancelled separately through Apple or Stripe.
(a) Subscription Plans. Certain features of the Service require a paid subscription. We offer monthly and annual subscription plans. Current pricing is displayed at the point of purchase within the app or on our website.
(b) Free Trials. We may offer free trial periods for certain subscription plans. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.
(c) Auto-Renewal. All subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged at the then-current rate for the next billing period.
(d) Payment Processing. Payments are processed by Apple (for in-app purchases on iOS) or Stripe (for web purchases). We do not store your credit card information. All payment processing is handled by these third-party providers in accordance with their respective terms and privacy policies.
(e) Cancellation. You may cancel your subscription at any time. For iOS subscriptions, manage your subscription through your Apple ID account settings. For web subscriptions, manage your subscription through the account page on our website or by contacting hello@inversegratitude.com. Cancellation takes effect at the end of the current billing period; you will retain access to premium features until that date.
(f) Refunds. For iOS in-app purchases, refunds are handled by Apple in accordance with Apple's refund policies. For web purchases processed by Stripe, please contact us at hello@inversegratitude.com to request a refund. Refunds are provided at our discretion.
If you access the Service through the Apple App Store, the following additional terms apply:
(a) This Agreement is between you and Inverse Gratitude LLC only, and not with Apple. Apple has no obligation to furnish any maintenance or support services with respect to the app.
(b) In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the app.
(c) Apple is not responsible for addressing any claims relating to the app, including product liability, regulatory compliance, or intellectual property infringement.
(d) Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
With your permission, we may send push notifications to your device for daily reminders and service-related notices. You can disable push notifications at any time through your device settings.
(a) License. You are granted a revocable, non-transferable license to access and use the Service, including the mobile application, for personal, non-commercial use.
(b) Termination. We reserve the right to modify, suspend, or terminate your access privileges at any time for failure to abide by these Terms.
You agree not to: (a) Use the Service for unlawful or fraudulent purposes; (b) Cause nuisance or annoyance; (c) Use content for commercial purposes or scraping; (d) Violate the privacy rights of others; or (e) Use our Service to develop artificial intelligence models without express written consent.
We own all rights, title, and interest in the Service, including logos, content, and AI-generated stories. Any Feedback you provide is at your own risk, and you grant us a perpetual license to use such Feedback without obligation to you.
The Service may contain links to third-party websites. We are not responsible for the content or practices of these third parties. You use such links at your own risk.
Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect and use your information. Agreement to these Terms of Use does not constitute automatic enrollment in our SMS messaging program.
You agree to indemnify and hold harmless Inverse Gratitude LLC, its members, managers, officers, employees, and agents from any claims, losses, or expenses (including attorneys' fees) arising out of your use of the Service or violation of this Agreement.
The Service is provided on an "as is" basis without warranties of any kind. We do not warrant that the Service will be uninterrupted or error-free.
To the fullest extent permitted by law, Inverse Gratitude LLC, including its members, managers, officers, employees, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.
In no event shall the total liability of Inverse Gratitude LLC, its members, managers, or agents, for any claim arising out of this agreement exceed $100 or the fees paid by you in the previous two months, whichever is greater. The member(s) of Inverse Gratitude LLC shall not be personally liable for any debts, obligations, or liabilities of the company.
Please read this section carefully. It requires you to arbitrate disputes with us individually.
(a) Scope. Any dispute relating to your use of the Service will be resolved by binding arbitration.
(b) Informal Resolution. Before demanding arbitration, you agree to meet and confer via telephone or video conference to resolve the claim informally.
(c) Waiver. You waive your right to a jury trial or to participate in a class action.
This Agreement is governed by the laws of the State of Illinois, without regard to its conflict of laws principles. Any permitted litigation will be conducted exclusively in the state or federal courts located in Cook County, Illinois.
(a) Messaging Hours. To comply with state and federal regulations, including but not limited to the Florida Telephone Solicitation Act and the Telephone Consumer Protection Act (TCPA), we will only send SMS/text messages between the hours of 8:00 AM and 8:00 PM in your local time zone.
(b) Time Zone Determination. Your local time zone is determined based on the area code of your registered mobile phone number or other information you provide to us. If we are unable to determine your time zone, we will default to Eastern Time (ET).
(c) Quiet Hours. We respect your personal time and will not send promotional or non-urgent messages outside of the permitted hours. Service-critical messages (such as opt-out confirmations) may be sent at any time as legally required.
(a) Electronic Communications. You consent to receive communications from us in electronic form.
(b) Entire Agreement. This is the exclusive agreement between the parties regarding the Service.
(c) Modifications. We may update these Terms from time to time. Continued use of the Service constitutes acknowledgement of the updated Terms.
